Litigation and Arbitration
The Litigation and Arbitration Department has a group of lawyers specialized in providing comprehensive advice for the resolution of conflicts in civil and commercial matters, including among its clients national and international companies that carry out their activities both in the public and private spheres. The department includes lawyers who are experts in civil, corporate, procedural, arbitration and consumer protection law, and who have extensive professional experience in conflicts related to banking and financial law, corporate law, energy, natural resources and construction, among others.
- International arbitration: We represent clients in international, commercial and investment arbitrations, conducted under the rules of the main arbitration institutions in the world (ICC, LCIA, ICDR, ICSID, CCB among others) as well as ad-hoc. Our experience includes arbitrations in matters of construction and engineering, public concessions, oil and gas, corporate disputes (MOUs and joint ventures), energy and mining.
- National arbitration: We represent clients in national arbitrations before the main arbitration institutions in the country. Our practice has focused mainly on cases related to the energy sectors (with special emphasis on oil and gas marketing contracts and mining and renewable energy projects), ports, construction and engineering, telecommunications; and, in general, commercial disputes and state contracts.
- Litigation before the civil jurisdiction: We represent clients in declaratory and executive proceedings before the ordinary jurisdiction, including the extraordinary resources that may be appropriate, as the case may be. Our practice has focused mainly on litigation between private parties, in extra-contractual and contractual claims, with special emphasis on disputes arising from or related to intermediation, distribution, and commercial agency contracts, purchase and sale of shares and other assets, construction and infrastructure contracts, contracts specific to the oil and gas sector, and corporate disputes of all kinds, among others.
- Litigation before the administrative litigation jurisdiction: We represent clients in the protection of their interests within the framework of administrative procedures before authorities, as well as in the exercise of means of control (nullity actions, nullity and restoration of rights, direct reparation, contractual disputes, repetition, popular actions, group actions, and enforcement actions) before the administrative litigation jurisdiction.
- Constitutional actions: We represent clients in unconstitutionality actions, popular actions, group enforcement actions, and tutelas. Within the framework of popular actions, our practice has focused on the defense against claims of all kinds, related to collective rights, including collective rights to the environment and health, among others. In class actions, we have focused on the defense against claims against insurers, digital platforms, public service companies, among others. In tutela actions we have represented our clients to request the protection of their fundamental rights, and we have defended them against claims for alleged violations of said rights, independently or in the context of other ongoing disputes and litigation
